TCCA approves the reentry into service
for the Boeing 737 MAX
After 20 months of investigation, design
review and consultations, Transport Canada Civil
Aviation has approved the Boeing 737 MAX to
reenter service. This was approved Jan. 20, 2021.
This process has been extensive and has taken
a lot of resources in the TCCA. The estimate is
that over 15,000 hours of work has been put in by
TCCA staff on this issue.
The issues with the Boeing 737 MAX and
the outcome of the investigation is likely to
have wide-ranging effects on the aircraft design
industry. The TCCA has played an important role
in this process and, in some cases, caused some
backlash because of its positions. However, in
the end, the TCCA is confident that the measures
being taken will bring the level of safety of the
737 MAX back to the 737 standard.
If you have not read the Federal Aviation
Administration or congressional reports issued
to date, you should. There is a lot of good
information in these reports, and it paints the
picture as to what may be coming down the
regulatory road for aircraft certification and
delegation. The effect this has had on the TCCA
and its oversight activities in aircraft certification
can already be seen. The level of reviews being
completed on complex systems and software has
changed. The level of inquiry into these systems
and potential faults has increased. Perhaps, there
is a level of unease.
The TCCA was put under a lot of scrutiny by
the government, industry and other authorities
in this process. In the end, I believe the agency
did the right thing and was able to defend the
bilateral process it has with the FAA and others.
But like many things in our business, we learn
from mistakes. Despite your best efforts, not

everything can be accounted for. We would never
progress if we tried to do so. However, expect
that there will be a review on many policies and
procedures to see where we can improve. This may
place a burden on the industry for a little while, but
when the process is finished, we should have a moreefficient and safer system.
The design changes required to be installed on the
737 MAX have been mandated by a unique Canadian
AD. This AD requires the implementation of the new
software for the flight control computer, new software
for the MAX display system, the addition of colored
caps on circuit breakers for the stick shaker, wiring
routing changes to the H-Stab trim system to improve
the physical separation of the wiring and a Canadian
AFMS. This AFMS includes a procedure to allow the
pilot to disable the loud and intrusive warning system
for the stick shaker when it has been erroneously
activated by a failure of the angle-of-attack sensor
system.
The TCCA has approved a new training syllabus
for the 737 MAX, and all pilots will have to
complete this new training before having their type
ratings renewed. Also, the airlines have a specific
maintenance inspection protocol to complete in order
to return the aircraft to service after having been in
storage all this time.
