exclusive licenses to inventions which develop as a
result of cooperative research with scientists employed
by federal laboratories.
In support of the FAA's efforts to investigate the scope of
this issue, the AEA asks the membership when performing
other maintenance to take a look at the ADS-B Out
installation paperwork and check to see that the paperwork
(Flight Manual Supplement and Instructions for Continued
Airworthiness) matches the host aircraft and not the original
STC. If the paperwork is a mismatch, please notify the aircraft
owner/operator and send an email to the AEA. This will help
define the scope of any failure in the paperwork.
Workforce Development
The other topic of special interest from the morning
regulatory sessions was the announcement that the AEA
avionics apprenticeship program was reviewed by the
FAA and found to meet the requirements to be deemed an
acceptable training program for the issuance of a repairman
certificate (see page 11 for more details).
As you know, the AEA has been working for over
two decades in developing the standards for the avionics
technicians. This work began with countless face-to-face
meetings with the membership at the (then) AEA Regional
Meetings mapping what the shops were looking for in their
workforce. It followed with the testing standards of avionics
technicians through the National Center for Aerospace &
Transportation Technologies, which in 2014 was migrated to
ASTM International. The adoption of NCATT by ASTM also
facilitated the development of Committee F46 on Aerospace
Personnel. This committee established the standards to
which individuals are trained and then certified under the
NCATT designation. The idea of an industry-driven standard
for avionics technicians is in keeping with the National
Technology Transfer and Advancement Act of 1995. When
that law was written in 1995, Congress noted the following:
1. Bringing technology and industrial innovation to the
marketplace is central to the economic, environmental,
and social well-being of the people of the United
States.
2. The federal government can help United States
business to speed the development of new products
and processes by entering into cooperative research
and development agreements which make available the
assistance of federal laboratories to the private sector,
but the commercialization of technology and industrial
innovation in the United States depends upon actions
by business.
3. The commercialization of technology and industrial
innovation in the United States will be enhanced if
companies, in return for reasonable compensation
to the federal government, can more easily obtain

The state of avionics and electronics development in
aerospace is so dynamic that the only way for technician
qualifications to stay reasonably current is for an industrydriven
consensus standard that allows for rapid dynamic
changes as new technologies are introduced.
In 2018, the AEA petitioned the FAA to review and accept
the avionics testing and certification as provided for through
NCATT as an acceptable training program under 14 CFR
65.101 (a)(5)(ii). The FAA agreed with the AEA's petition,
and on Dec. 7, 2018, sent a letter that stated in part: " We
agree that presentation of the NCATT AET certification along
with a minimum of one additional endorsement to meet the
intent of the regulation stated in 14 CFR section 65.101 (a)(5)
(ii) for the issuance of a repairman's certificate. "
Following the FAA's acceptance of the avionics
certification through NCATT, the AEA began work with
the help of the Urban Institute to develop a formal avionics
technician apprenticeship program that was recognized by the
United States Department of Labor. This was accomplished
with the Oct. 31, 2020, publication of the Department of
Labor Employment and Training Administration, Office of
Apprenticeship, Bulletin 2020-12. Now the avionics industry
had an approved technician apprenticeship program that
was federally approved and locally accepted, which not
only supported the recruitment of new technicians but may
also provide state and local training and retraining funding
opportunities for the avionics industry.
Earlier this year, the AEA again petitioned the FAA
for review and acceptance of the avionics technician
apprenticeship program as an acceptable training program.
Once again, the FAA agreed with the association and on
June 16, 2021, formally accepted the AEA's DOL-approved
program with a letter that stated in part: " We agree that
successful completion of this program will meet the intent of
the regulation stated in 14 CFR section 65.101 (a)(5)(ii) for
the issuance of a repairman's certificate. "
With these efforts, there are now four means for a
technician to meet the eligibility requirements to become a
repairman:
1. Have at least 18 months of practical experience in the
procedures, practices, inspection methods, materials,
tools, machine tools, and equipment generally used in
the maintenance duties of the specific job for which
the person is to be employed and certificated; or
2. Complete formal training that is acceptable to the
administrator; or
3. Test and become NCATT certified as an aircraft
electronics technician (with one additional NCATT
avionics endorsement); and
