A
s the Experimental Aircraft Association's
2021 AirVenture Oshkosh wrapped up and
numerous discussions took place about
new products and the term " safety continuum " that
seems to be the solution for all things aviation, I was
thinking about what exactly this means and, in particular,
the roles that the " applicant " plays in all of this.
As we look at the regulations, whether the maintenance
regulations, the repair station regulations, or the product
certification regulations, they all have one thing in
common: They define " what " must be done, and they
generally do not specify " how " they must be done. In fact,
the Part 23 rulemaking activity that received much attention
a few years ago was intended to review 14 CFR Part 23
for " prescriptive " language and replace the language with
basic performance goals. The resulting Part 23, for the
most part, is a performance-based regulation with very
little prescriptive " how-to language " contained in the rule.
14 CFR Part 145 has normally been a performance-based
regulation from its inception in 1938. The 1999-2001
rulemaking further cleaned up Part 145.
But you knew this was coming: There is no free lunch!

standards, the means and methods of compliance become
more important and much more complex. For the record,
means of compliance and method of compliance are
different. The Federal Aviation Administration defines them
in Advisory Circular 23.2010-1, FAA Accepted Means of
Compliance Process for 14 CFR Part 23, as:
Means of Compliance - A detailed design standard
that, if met, accomplishes the safety intent of
the regulation, is used by an applicant to show
compliance with Part 23 airworthiness standards,
and accepted by the administrator. A means of
compliance is one method, but not the only method,
to show compliance with a regulatory requirement.
