Canada
Acceptability of FAA STCs on
Canadian registered aircraft
The following information is from
Transport Canada Civil Aviation.
Question: This question was submitted by
an AEA member company.
We have a customer with Canadian
registered aircraft that asked us to install
a Garmin GI 275. In Canada, it is labeled
as a Harvard 4, which of course is not an
aircraft model that the Federal Aviation
Administration acknowledges. The TCDS
A-2-575 calls it an AT 6 (SNJ-2), which is on
the Garmin AML.
Do we have a pathway for installation? Is it
as simple as reaching out to the civil aviation
authority and asking for an approval? How
does TC address the same TCDS but different
model names?
Answer: To answer this question, the AEA
reached out to Transport Canada headquarters,
which then reached out to the Aircraft
Certification Standards Division, Standards
Branch. The following is the response:
TCCA treats the TCDS for these aircraft
as two separate type certificates with two
different states of design. The Canadian
registered aircraft is listed as a Harvard 4
(IV) design and manufactured to Canadian
Type Certificate A-80. TC A-2-575 for the
AT-6 is listed on the U.S. eligible aircraft
list for which TCCA has accepted. Although
the aircraft may be similar, they are two
different aircraft with two separate TCs.
Since Canada is the state of design
for the Harvard 4, any foreign product
intended to be installed on it would be
subject to validation of its foreign design
approval. Since the design approval
in this case is an FAA-issued STC, it
would be subject to an application and
subsequent validation per the criteria
outlined in the U.S./Canadian bilateral
agreement's Implementation Procedures
for Airworthiness.
Based on the above, the FAA AML STC
SA02658SE for the installation of a
Garmin GI 275 on (the Harvard) would
not be applicable and not meet the data
requirements under CAR 571.06 and the
applicable provisions of the TCCA-FAA MIP.
This is an important question for many
aircraft. While one aircraft may look
like another, it is important to determine
and identify the state of design, state of
manufacturing, and the state of registry.
Each " state " may affect the ability to alter or
maintain that aircraft. Again, as discussed at
last year's AEA Connect Conferences, the
Type Certificate Data Sheet is a foundational
document in addressing the authority or the
responsibility to maintain or alter an aircraft. q
