Accountable Manager
The following information is from 14 CFR Part
145 and EASA/EC Commission Regulation (EC) No
2042/2003, Annex II, (Part-145)
Question: What is an accountable manager?
Answer: To answer the question, we start with
the regulations.
By looking to Federal Aviation Administration
regulations, we see under Subpart D, Personnel,
that each certificated repair station must designate
a repair station employee as the accountable manager
(14 CFR sec. 145.151(a)). When we look at
the definition of accountable manager in section
145.3(a), we find this person:
1. Has been designated by the repair station;
2. Has responsibility for the repair station
operations;
3. Has authority over all repair station operations;
4. Has responsibility for ensuring that the repair
station personnel follow the regulations; and
5. Act as the primary contact with the FAA.
What is an accountable manager? Based on the
regulation, the accountable manager is (1) the person
formally designated by the business entity that
holds the air agency certificate, and (2) satisfies the
requirements of items 2-5 above.
The preamble language for the Aug. 6, 2001, Part
145 final rule is where the FAA discusses its intent.
* The FAA has determined that it is necessary for
a repair station to have one individual who is
responsible for ensuring repair station operations
are conducted in accordance with Part 145.
* However, the FAA has revised the definition
of ''accountable manager'' to clarify that
the person in this position is responsible for
and has authority over only repair station
operations conducted under Part 145. It was not
the FAA's intent to dictate who is responsible
for repair station operations that are unrelated
to Part 145, such as accounting.
* The FAA notes that the term ''accountable
manager'' is consistent with JAR terminology,
and its use is consistent with the FAA's
harmonization efforts.
* Finally, the FAA notes the definition in this
final rule states that the accountable manager
will serve as the primary contact with the FAA
as suggested by many commenters.
It is important to note that the European Union
Aviation Safety Agency has a slightly different
requirement than the FAA.
145.A.30 Personnel requirements
(a) The organization shall appoint an accountable
manager who has corporate authority for ensuring
that all maintenance required by the customer can
be financed and carried out to the standard required
by this Part. The accountable manager shall:
1. Ensure that all necessary resources are
available to accomplish maintenance in
accordance with 145.A.65(b) to support the
organization approval.
2. Establish and promote the safety and quality
policy specified in 145.A.65(a).
3. Demonstrate a basic understanding of this Part.
From the 145 AMC:
(a) With regard to the accountable manager, it is
normally intended to mean the chief executive officer
of the approved maintenance organization, who
by virtue of position has overall (including financial)
responsibility for running the organization.
The accountable manager may be the accountable
manager for more than one organization and is not
required to be necessarily knowledgeable on technical
matters as the maintenance organization exposition
defines the maintenance standards. When the
accountable manager is not the chief executive officer,
the competent authority will need to be assured
that such an accountable manager has direct access
to the chief executive officer and has a sufficiency
of " maintenance funding " allocation.
For repair stations holding dual certificates, it
is important to understand the subtle differences
between the two systems. q
