TCCA issues exemption for
use of NORSEE products
Several years ago, the FAA introduced a new
regulation in Part 21 to define which methods can
be used to approve an article. This was originally
introduced to provide a clear requirement on the
approval of items that can be used on an aircraft.
Subsequent to this new rule, the FAA issued a
policy that allowed for the design and production
approval for systems which are not required by
the regulation and whose failure condition does
minor or less. This policy has been referred to
as non-required safety-enhancing equipment,
or NORSEE. The concept was to allow for an
easier introduction of new technology with safety
benefits outweighing the normal regulatory
requirements for a technical standard order
approval. An example of a NORSEE system is an
angle-of-attack indicator.
Transport Canada Civil Aviation did have some
acceptance of this new FAA policy after review.
However, the regulatory structure in Canada is
different and did not allow for the use of these items
on Canadian-registered aircraft. CAR 571.07 defines
the requirements for installing new parts. In this
regulation, the basic requirement is the part must
either meet the definition of a standard or commercial
part or be released by an approved manufacturer
under CAR 561. The NORSEE products do not fit
into the definition provided in CAR 571.07 and,
therefore, could not be installed even with the
issuance of a supplemental type certificate. There is
also a requirement in 571.10 requiring the aircraft
maintenance engineer to make a statement that the
part meets an approved type design.
Therefore, TCCA has issued exemption NCR-0242022,
which exempts installers from meeting the
requirements of CAR 571.07(1) and CAR 571.10(1),
thus allowing for the installation of a NORSEE
product. The exemption, however, does not preclude
the installer from determining whether the installed
equipment is a major or minor type design change.
This still must be done, and if it is a major change,
There are four other conditions that must also
be met in order for the exemption to apply.
1. This exemption only applies to small
aircraft as defined in CAR 101.
2. The NORSEE product cannot replace any
equipment required as part of the type
design of the aircraft.
3. There must be a verification that the
product has been approved by the FAA in
accordance with its policy statement, PSAIR-21.8-1602.

The product must be accompanied by
a certificate of conformance from the
NORSEE product manufacturer.

Nav Canada issues update
on ADS-B mandate
Nav Canada issued a policy update in late
July on the ADS-B requirements in Canadian
airspace. The update indicates that Nav Canada
is recognizing the challenges that the industry
continues to face as the economy recovers and the
supply chain issues are resolved. It does not note
any other challenges in meeting this requirement in
the time frame put forward in the early spring. This
is somewhat concerning since there are several
challenges in place that will make meeting the
ADS-B mandate difficult.
Nav Canada has adjusted its timeline for the
mandate due to this consideration. The mandate will
now come into effect for Class A airspace on Aug.
10, 2023, and for Class B airspace, May 16, 2024.
To a certain degree, this is welcome news and
provides some breathing space for those aircraft not yet
properly equipped with a diversity system. It will also
help the industry further advocate for additional changes
to the mandate timeline and ensure it is implemented in
a fashion that has less impact on the industry.
As of mid-August, there had been no feedback from
TCCA on the ADS-B mandate or the development of
installation and equipment requirements. q
