operation of the association. Nor does
it mean the association must copy and
mail them to the lawyer. Rather, the association
may provide an opportunity to
a unit owner or his lawyer to review the
association's records and if necessary,
take copies of anything not privileged,
e.g., legal opinions or not fi nalized bids
for contracts not yet executed.
More importantly, " reasonably
available " does not mean that the association
must provide documents or
information which would typically be
objectionable if the unit owner had
instituted a lawsuit against the association.
Specifi cally, a request for
all records involving the unit owner's
claim, if asked during a lawsuit, would
be subject to the following objections
pursuant to the Rhode Island Rules of
Civil Procedure:
● The request is overly broad
or unduly burdensome.
● The request is vague, ambiguous,
or unintelligible.
● The request is not reasonably
calculated to lead to the discovery
of relevant, admissible evidence.
● The request is not relevant
to the litigation.
● The request calls for a
legal conclusion.
By the time this article is published,
I anticipate that the issue will have
been resolved, and should a lawsuit
commence, the question of just what records
an association must provide a unit
owner to address his or her inquiry will
be answered by using the standards set
forth in the Rhode Island Rules of Civil
Procedure and not by an unreasonable
and unintended stretch of the Condominium
Act's records access statute.
In other words, " nice try, but no. "
