Cal/OSHA ETS Hearing Update

COVID-19 Vaccines for Ag Workers

The legal challenge to the Cal/OSHA emergency temporary
standards (ETS) - for protection against the spread of COVID-19
in the workplace - was heard in its first judicial hearing on
Jan. 28. Plaintiffs in the case are CAWG, Western Growers
Association, California Farm Bureau Federation, California
Business Roundtable, the Grower-Shipper Association of Central
California and the Ventura County Agricultural Association.

The Newsom administration openly acknowledges it has gotten
off to a bit of a rough start in getting vaccines into the arms of
those in targeted communities. Part of the problem has been
related to the limited supply and vast challenges in distribution.
However, identifying those who immediately receive vaccines
has also been a challenge resulting in evolving prioritization and
confusion from county to county.

After hearing testimony from the plaintiffs, Judge Ethan
Schulman issued a tentative ruling declining to issue a stay
against the ETS, indicating deference to the state during the
present COVID-19 emergency. The hearing involved additional
substantial information, but it is not clear where the court is
headed. Ultimately, the judge asked for additional filings in
advance of the next hearing on Feb. 11.

To clear up the confusion in prioritization, the California
Department of Public Health recently released new guidelines for
vaccine allocations. The Updated COVID-19 Vaccine Allocation
Guidelines make it clear that ag employees are eligible to receive
vaccines as soon as the vaccines are available in their county.

CAWG Director of Government Relations Michael Miiller was
asked to serve on Cal/OSHA's advisory committee for the
COVID-19 ETS. The committee, which will provide input on
proposed changes to the ETS, includes about 30 individuals
from agriculture, business, labor and community groups; public
agencies; and the health sciences. Meetings are slated for Feb. 11,
12 and 16.

-	 Sector populations: Education and childcare, emergency
services, food and agriculture.

LLP discussed legal issues related to the COVID-19 vaccine,
including the permissibility of mandatory employee vaccination
policies and other workplace issues triggered by the vaccine.

Based on available supply, individuals described below are or
will be eligible for COVID-19 vaccines:

This age-based framework will be coupled with a vaccine
distribution and engagement approach that prioritizes
disproportionately impacted communities, settings and
populations to ensure those eligible for vaccines within these
communities are more likely to receive it.
Grape growers may want to ask employees to check availability
and register online at myturn.ca.gov. Additionally, employers
may want to reach out to healthcare providers and county health
offices to determine local efforts to get vaccines to ag employees.
The goal is for ag employees to receive vaccination shots within
the next few weeks.
