On March 17, 2022, the DOL published proposed regulations
that, if promulgated, could dramatically expand DBA
coverage of secondary sites and for truck drivers. The stated
purposes of the new rules are:
(1) Revising the definition of " site of the work " to further encompass
certain construction of significant portions of a building or work at
secondary worksites.
(2) Clarifying the application of the " site of the work " principle to
flaggers.
(3) Revising the regulations to better delineate and clarify the
" material supplier " exemption.
(4) Revising the regulations to set clear standards for DBA coverage of
truck drivers.
Under the new rule, contractors would be
required to pay prevailing wages and
fringes to employees working on sites
created before and without regard to a
particular federal project.
Among the stated reasons for the rule change, the DOL cited
the fact that, with modern construction, a large amount of
construction that would traditionally be constructed on the
site (where the project feature will remain) is taking place at
offsite locations. Given the " significant portion " of the work
being performed offsite, " it is fair and reasonable to view such
location as a site where the public building or work is being
constructed. " 65 FR at 80274. Accordingly, the proposed rule
extends the DBA coverage to any secondary site where a
" significant portion " of the construction work takes place and
eliminates the requirement that the site be established
specifically for the performance of the project. Under the new
rule, contractors would be required to pay prevailing wages
and fringes to employees working on sites created before and
without regard to a particular federal project (e.g., tool yards,
storage or laydown sites, etc.).
The proposed rule also extends coverage to truck drivers
for certain activities related to federal projects. The rule
does so by adding " covered transportation " to the categories
of activities covered by the DBA. The covered types of
transportation include:
(1) Transportation that takes place entirely within a location meeting
the definition of site of the work (for example, hauling materials
from one side of a construction site to the other side of the same
site).
(2) Transportation of portion(s) of the building or work between a
" secondary construction site " and a " primary construction site. "
(3) Transportation between a " nearby dedicated support site " and
either a primary or secondary construction site.
(4) A driver or driver's assistant's " onsite activities essential or
incidental to offsite transportation, " discussed further below,
where the driver or driver's assistant's time spent on the site of the
work is not so insubstantial or insignificant that it cannot as a
practical administrative matter be precisely recorded.
(5) Any transportation and related activities, whether on or off the site
of the work, by laborers and mechanics under a statute that
extends Davis-Bacon coverage to all laborers and mechanics
employed in the construction or development of a project.
The proposed rule for truck drivers may have the effect of
causing contractors and vendors to strictly limit the time and
activities of truck drivers on federal construction sites or
covered secondary sites.
