DFI Collaborates on Risk-Based Panels
Two DFI committees independently
organized two complimentary panel
sessions for the recent American
Society of Civil Engineers' (ASCE) GeoRisk
2023 " Advances in Theory and
Innovation in Practice " Conference in
Arlington, Virginia, July 23-26. The GeoInstitute
(GI) specialty conference
welcomed more than 200 professionals
and students interested in risk from
around the world to the Washington,
D.C., area for three full days of plenary
keynote lectures, papers and no-paper
sessions. The GI Risk Assessment and
Management Technical Committee
organized the event, which is the third
in a series planned on a 6-year cycle.
The previous two events were in 2011
in Atlanta and 2017 in Denver.
Project Delivery Risk
The Risk and Contracts Committee
organized a panel-based session on
project delivery risk in deep foundations,
discussing legal and operational
approaches. The focus of this DFI
committee is identifying risk and how to
evaluate and manage risk for all entities
involved in geotechnical projects. The
committee cooperates with all other DFI
technical committees and liaises with
the Geo-Industry Risk Working Group.
The session at Geo-Risk helped raise
awareness of deep foundations risk
management and provided an opportunity
for attendees to see practical
considerations of risk in addition to the
latest research provided in the other
technical sessions.
The four invited panelists explored
the differences in risks of the classic
design-bid-build delivery system and
the design-build project delivery
system, and discussed the opportunities
design-build procurement is
presenting geotechnical design and
construction companies. Panelists
included: Kevin Cargill, Schnabel
Foundation Company; Larry Moore, P.E.,
GeoStructures; Richard Kalson, Esq.,

DFI and Benesch Friedlander Coplan &
Aronoff; and Alexander Filotti, DFI and
Citnalta Construction. Kalson and
Filotti moderated the session.
This panel, " Project Delivery Risk in
Deep Foundations - Legal and Operational
Approaches, " was in the first concurrent
technical sessions and helped
kick off the conference with practical
content from project experience. Session
highlights included Kalson discussing
several legal topics including the
Spearin Doctrine, and two distinct types
of Differing Site Conditions (DSC):
* Type 1 DSC arising where the actual
site conditions encountered during
the performance of the work differ
materially from the conditions
described in the contract documents.
* Type 2 DSC is present when the
actual conditions are unusual and
unforeseen, and differ from conditions
usually encountered in the type
of work specified in the area.
