Minnesota
A Native American tribe in Minnesota launched recreational marijuana sales on Aug. 1, the first day the
state's new law legalizing possession, use and home grows went into effect.
NativeCare, which previously sold medical marijuana, opened its doors to consumers on the remote
Red Lake Nation, sparking a new era for cannabis advocates in the Midwest market.
More than 100 shoppers lined up to be among the first to purchase recreational marijuana at
NativeCare, with some driving hours from neighboring states.
Six days later, White Earth Nation, another Minnesota tribe, opened its own adult-use store in
Mahnomen.
Tribes will have at least a one-year head start on sales over state-licensed medical and recreational
cannabis retailers and other marijuana operators. Adult-use licenses are expected to be issued in late
2024, with stores opening in early 2025, industry insiders told MJBizDaily.
Missouri
Results from the first lottery for 48 marijuana microbusiness licenses will be announced Oct. 2-4.
A total of 144 such licenses will be issued by the Missouri Department of Health and Senior Services
(DHSS) through three random lotteries held over 18 months, according to the department. The licenses
will be split across Missouri's eight congressional districts, with four wholesale licenses and two
dispensary licenses per district.
Applicants do not have to be Missouri residents, although majority owners must meet at least one
eligibility criteria such as having a disability connected to military service, having been convicted of a
nonviolent marijuana offense or residing in a qualifying ZIP code.
Applicants not selected by the lottery will be eligible to have their $1,500 application fee refunded
under certain conditions.
Montana
Two out-of-state investors are suing to overturn a Montana law that requires owners of marijuana
businesses to be state residents.
In two lawsuits filed in federal and state court in July, father-and-son plaintiffs Tom and Jerry Reed
claim Montana's marijuana business ownership residency requirements violate the U.S. and Montana
constitutions.
Other would-be marijuana entrepreneurs have deployed similar arguments in other states after a
federal judge's ruling last year nullified a residency requirement in Maine.
The U.S. Supreme Court has ruled that residency requirements in other industries violate the U.S.
Constitution.
In their filings, the Reeds claim to have invested $2.2 million in a Montana-based marijuana business
called MBM Management and Consulting. MBM failed to disclose the state's residency requirement to
the Reeds before they invested, according to filings. Regulators discovered the investors weren't state
residents and moved to revoke MBM's license.
New Hampshire
State lawmakers voted to ban most products containing hemp-derived cannabinoids, including delta-8
THC.
Gov. Chris Sununu proposed limiting sales to state-run stores, similar to how New Hampshire regulates
the sale of liquor. No other U.S. marijuana market has tried to restrict sales to state-run stores.
Under House Bill 611, which Sununu signed into law, a state commission comprised of legislators, law
enforcement, bankers and legal and medical experts will deliver a report evaluating Sununu's favored
model by Dec. 1. The new law also:
* Removed a requirement mandating that severe pain be resistant to other treatment before it can
be a qualifying condition for medical marijuana.
* Banned the sale of hemp-derived products containing more than 0.3% THC on a dry-weight basis,
including " delta-8 THC, delta-9 THC or any other THC isomer variant. "
