Rhode Island
A cannabis retailer filed a lawsuit against the state, arguing that its adult-use legalization law unfairly
forces stores to enter " oppressive " labor peace agreements with its employees.
Portsmouth-based Greenleaf Compassionate Care Center, which has been operating in the medical
marijuana market since 2013, named state regulators and Cannabis Control Commission members in
the suit.
Passed in May 2022,the Rhode Island Cannabis Act legalizing recreational sales includes a clause
stating that licenses are contingent on marijuana retailers signing labor agreements with a " bona fide
labor organization. "
" You either meet their demands and obtain a peace agreement or you go out of business under
Rhode Island law, " said Seth Bock, CEO of Greenleaf.
Bock would like the requirement to be declared unconstitutional and for its collective bargaining
agreement, which includes a $1,000 bonus for employees, to be nullified.
South Dakota
A state resident launched an effort to repeal South Dakota's medical marijuana law.
According to state Attorney General Marty Jackley, Newell resident Travis Ismay's proposed ballot
initiative would:
* Repeal the state's medical cannabis program.
* Outlaw the MMJ dispensaries currently in operation.
* Make all possession and use of cannabis products a crime.
The proposal would have no impact on South Dakota's hemp industry.
If his proposal advances, Ismay would have to collect more than 17,000 signatures to qualify his
measure for the 2024 ballot.
Vermont
Despite suffering crop and other losses, Vermont marijuana cultivators, retailers and manufacturers are
barred from accessing any federal aid in the wake of devastating floods that swamped the state in July.
Marijuana farmers also are ineligible for federal crop insurance money, even if U.S. Secretary of
Agriculture Tom Vilsack approves Gov. Phil Scott's emergency request for a Department of Agriculture
disaster declaration.
The Vermont Growers Association reported that cannabis operators showed losses to indoor and
outdoor crops as well as production facilities.
The lack of federal aid is a bitter reminder that cannabis companies nationwide have little recourse
after natural disasters such as wildfires, floods and heat waves, an unwelcome weather trifecta
affecting several parts of the United States and Canada this summer.
Virginia
Authorities are cracking down on stores selling unauthorized hemp-derived products under a new law
and handing out significant fines in the enforcement push.
The Virginia Department of Agriculture and Consumer Services had issued five noncompliance letters
to businesses as of late July, with fines ranging from $13,000 to $97,500.
Fines could be reduced to $10,000 if business owners bring their stores into compliance and meet
other conditions.
The store that faced the largest fine reportedly sold some hemp products containing more than the
0.3% legal limit of THC and others that contained synthetic THC as well as infused goods that looked
like mainstream snacks.
Although medical marijuana is legal in Virginia, Gov. Glenn Youngkin recently made clear that adultuse
marijuana legalization won't take place during his time in office.
