FDA Declines to Regulate
$4 Billion CBD Market
Four years after the 2018 U.S. Farm
Bill legalized hemp production
nationwide, the U.S. Food and Drug
Administration announced that it
won't regulate products containing
cannabidiol (CBD) and will instead
pass the buck to Congress.
" I don't think this changes
anything for now, whether you're
in the CBD space, the delta-9 (THC)
space or the delta-8 (THC) space, "
said Jonathan Havens, a Baltimorebased
attorney at Saul Ewing who
previously served as FDA counsel.
While CBD companies have
been waiting years for the FDA
to publish regulations for CBD
products, the agency has taken
a mostly hands-off approach,
sending enforcement letters only
to companies marketing products
using unfounded medical claims.
In legalizing hemp production,
the 2018 Farm Bill created a boom
in the CBD market along with
the rise of novel intoxicating
cannabinoids derived from hemp,
such as delta-8 THC.
Which cannabinoids might be
allowed in consumer goods is
one of the questions that could
be answered at the same time
Congress negotiates a new version
of the 2018 Farm Bill, which expires
this year.

Argentina Launches Cannabis
Regulator, Eyes Exports
Argentina launched a national
regulatory agency for the hemp
and medical marijuana industries,
aiming to capitalize on domestic
and international markets.
The governing body, Agencia
Regulatoria de la Industria del
Cáñamo y del Cannabis Medicinal,
seeks to regulate and foster a
variety of cannabis-related sectors,
such as industrial hemp, medical
marijuana and cannabinoids for
food, cosmetics and veterinary use.
The agency seeks to establish
clear rules for the sector and
monitor noncompliance with the
regulatory regime. It also will
be responsible for authorizing
imports, production, domestic
marketing and exports, according
to the Allende & Brea law firm in
Buenos Aires.
After an Argentinian cannabis
industry largely failed to materialize
in 2017, when the initial medical
cannabis law was approved,
authorities published a new
decree in 2020 aiming to address
previous medical marijuana rules'
shortcomings.
That decree allowed pharmacies
to dispense cannabis magistral
preparations and expanded the
industry's potential reach by
allowing access to medical cannabis
for any ailment-not just select
conditions.
Canada Targets 'Several'
Firms in Edibles Crackdown
Canada's top health regulator said
it is cracking down on cannabis
companies it alleges are selling
" erroneously " classified products
that far exceed the 10-milligram
THC limit governing individual
packages of edibles.
Health Canada told MJBizDaily
via email that it is working
with " several " companies to
resolve issues related to a lack
of compliance with the country's
cannabis regulations.
The agency recently handed
" stop sale " requests to producers
of some lozenges and chews
whose packages are classified
as extracts and contain more
than 100 milligrams of THC. The
federal regulator said it identified
products that should have been
classified as " edibles, " which
cannot exceed 10 milligrams of
THC per package.
Under Canadian cannabis
regulations, products classified
as extracts are capped at 1,000
milligrams of THC per package-or
100 times the allowable THC limit
governing packages of edibles.
" Health Canada has identified
edible cannabis products
erroneously being classified and
marketed as cannabis extract
products, " the public health agency
told MJBizDaily via email.
The regulator declined to state
exactly which products were
affected, nor would it share the
number of companies involved in
the crackdown.
The letters sent by the
Canadian government to several
license holders request that they
voluntarily stop selling
the products.
