Avoid a failed cover-up

L

awyers representing the former campaign manager for
President Donald Trump gained some unwelcome media
attention in January after an embarrassing mistake that is
all too easy to make. The attorneys for Paul J. Manafort Jr. filed a
PDF document on January 8, 2019 in the U.S. District Court
for the District of Columbia at Criminal No. 17-201 (ABJ).
https://bit.ly/2snnZOl. Counsel intended to redact portions of the
document by inserting black bars over the sensitive information.
Unfortunately, there was a simple trick for bypassing the black bars
and reading the entire filing. Anyone reading the PDF document
could gain access to the supposedly redacted information by simply
copying and pasting the black bars.
National news coverage of the "failed cover-up" by
Manafort's legal team brought to mind my Fall 2017 column
on Pennsylvania's New Public Access Policy. That column
included some information regarding proper document redaction.
Regardless of how notorious your clients may be, attorneys should
be implementing redaction to avoid significant embarrassment or
even malpractice. With that in mind, here are some practice tips
that can help you improve the security and effectiveness of your
redactions:

How to Redact a PDF Document

Redacting a document is easy, take out the big black marker,
cover-up what you want to redact, scan or copy the document and
you are done, right? Not so fast, modern copiers and scanners are
such high quality they can often see through that black marker
revealing the "redacted" material. So just use the more modern
electronic equivalent of the black marker by setting a black box
around the text to be redacted or be tricky and set the text to be
redacted to white so it is invisible, right? Unfortunately, these
methods do not redact the text which can often be recovered by

optical character recognition (OCR) through searching the text, by
cutting and pasting the black box (like Mr. Manafort's document),
or by changing the text color of the electronic document. So, no,
these techniques do not redact the text. So how do you redact a
document?
Many electronic discovery software systems offer effective
redaction tools, but the most popular and an effective redaction
tool is Adobe Acrobat Pro. The free Adobe Reader version does
not perform redaction. Adobe Acrobat Standard also does not
provide redaction. There are less expensive alternative PDF tools
which offer redaction which should be effective.

pdffiller.com).
* PDFelement is about $100 per computer and includes
redaction (https://pdf.wondershare.com).

* Nitro Pro is full featured PDF software for about $160 per
computer (https://store.gonitro.com).

* Nuance Power PDF Advanced (not Standard) has been one
of my favorite Adobe Acrobat Pro alternatives and is about
$180 per computer but look for discounts as low as $100
(http://www.nuance.com).
* Foxit PhantomPDF Business (not Standard) about $160
per computer (https://www.foxitsoftware.com), is the new
Dell computer sales default product. Redaction is a twophase process that lets you first mark the text or graphics for
