Remote Online Notarization at a Glance
Pennsylvania enacted Senate Bill 841 on April 20,
temporarily authorizing Pennsylvania-licensed notaries
to use "communication technology," to communicate
simultaneously in real time by sight and sound to notarize
signing of documents or perform other notarial acts for
remotely-located individuals. Communication technology
is defined as an electronic device or process that allows a
notary and remotely located individual. To be valid, the
following conditions must be met:
1)	 The Notary has personal knowledge of the
individual's identity or satisfactory evidence of his/her
identity by (1) oath or affirmation from credible witnesses
appearing before the notary, or (2) at least two different
types of "identify proofing" (defined as a process or service
provided by a third party that enables a notary to verify
the identity of a remotely located individual by a review of
personal information from public and private data sources);
2)	 The notary reasonably can confirm that the record
before him or her is the same record that the individual
signed or in which the individual made a statement.

3)	 The Notary, or a third party on his or her behalf,
creates an audio-visual recording of the notarial act using
specific identity proofing technology designated by the
Pennsylvania Department of State's March 25, 2020 notice.
4)	 The audio-visual recording must be retained for at
least 10 years;
5)	 The certificate of the notarial act must indicate
that the notarial act was performed using communication
technology; and
6)	 If the individual is out of the country, the record
must be connected to the United States in some substantial
way and the act of making the statement or signing the
record must not be prohibited in the country in which the
individual is located.
