De l'ambition pour la haute mer
La haute mer est parfois décrite comme une zone
de non-droit, mais elle fait déjà l'objet de mesures
de protection. Certaines concernent exclusivement
un secteur d'activité. L'organisation maritime internationale a ainsi défini des « zones maritimes particulièrement vulnérables » et certaines organisations
régionales des pêches se sont dotées de moyens pour
protéger des secteurs comprenant des écosystèmes
fragiles vis-à-vis des activités halieutiques.
Des aires marines protégées ont par ailleurs été mises
en place dans le cadre de conventions de mers régionales ou internationales.
La première fut créée en 2009 par la Convention sur
la conservation des ressources marines vivantes de
l'Antarctique (CCAMLR), sur le plateau sud des îles Orcades du Sud. En 2016, la même convention a trouvé
un accord pour protéger la mer de Ross. Cependant
la durée de vie de cette AMP est limitée à 25 ans,
condition sine qua non posée par la Russie. Née en
1992 pour lutter contre la pollution et pour préserver
le milieu marin du nord-est de l'Atlantique, la convention de mer régionale Ospar concerne quinze États.
En 2010, elle a créé six AMP en haute mer, généralement associées à des dorsales océaniques ou à des
monts sous-marins, et une septième en 2012, dans la
zone de Charlie-Gibbs nord. En plaidant pour l'ouverture de négociations en vue d'un futur accord pour
la gestion durable de la biodiversité en haute mer,
l'Union européenne cherche à établir un cadre pour
des AMP pérennes, et plus universelles.
