II. Modalités
A. Conditions du maintien
Le bénéfice du maintien des garanties est subordonné à la condition que les droits
« à remboursements complémentaires » aient été ouverts chez le dernier employeur. Il faut comprendre par cette formule que le salarié doit avoir rempli les
conditions d'ouverture des droits à la couverture complémentaire avant la cessation de son dernier contrat de travail. Cette condition suppose, par exemple, que
le salarié remplisse la condition d'ancienneté requise pour bénéficier du régime de
prévoyance de l'entreprise.
L'ancien salarié doit justifier auprès de l'organisme assureur, à l'ouverture et au
cours des périodes de portabilité des garanties, qu'il remplit les conditions de l'article L. 911-8 du Code de la sécurité sociale, et tout particulièrement qu'il est pris
en charge par le régime d'assurance chômage.
B. Garanties maintenues
À la différence du dispositif de l'article 4 de la loi n° 89-1009 du 31 décembre
1989, la portabilité instituée par l'article L. 911-8 du Code de la sécurité sociale ne
s'applique pas seulement à la couverture « frais de santé », mais à l'intégralité des
garanties prévoyance en vigueur dans l'entreprise (décès, incapacité, invalidité...).
Il en résulte que les salariés restent couverts par le contrat collectif de l'entreprise.
D'ailleurs, l'article 2 de la loi n° 89-1009 du 31 décembre 1989, relatif à la non-sélection des risques (v. supra), qui vise les opérations collectives à adhésion obligatoire
est applicable à la portabilité
Toutefois, le Code de la sécurité sociale institue un plafonnement des prestations
portées : le salarié ne peut percevoir des indemnités d'un montant supérieur à celui des allocations chômage qu'il aurait perçues au titre de la même période (CSS,
art. L. 911-8, 4°). Sont visées ici les indemnités dues en cas d'incapacité temporaire
de travail (garantie de ressources) ou en cas d'invalidité.
C. Informations
L'employeur doit informer le salarié de la portabilité de ses droits dans le certificat
de travail.
Conseils
Il est recommandé de faire figurer dans le certificat de travail un nombre minimum
d'informations, notamment, les garanties concernées, les conditions de la portabilité, sa durée, sa gratuité, ainsi que les coordonnées de l'organisme assureur auprès
duquel le salarié devra justifier de sa situation.
En outre, il convient de renvoyer le salarié à la notice d'information qui doit détailler
le mécanisme de portabilité.
