LA MODIFICATION OU
LA SUPPRESSION DU RÉGIME
Le régime de protection sociale complémentaire mis en place dans l'entreprise
est nécessairement amené à évoluer. Il peut être modifié ou même supprimé à
l'initiative de l'organisme assureur ou de l'employeur en raison d'un coût devenu
trop élevé pour l'entreprise ou de son inadaptation à l'évolution de la population
des salariés (rajeunissement, vieillissement...) ou encore de la résiliation du contrat
d'assurance par l'organisme assureur, en raison, par exemple, de la modification du
risque assuré ou du non-paiement des primes...
Section 1 * Mise en œuvre
La modification ou la suppression du régime impose de respecter les mêmes obligations d'information des représentants du personnel et des salariés que lors de sa
mise en place (v. supra). Ainsi, en cas de modification, l'employeur doit remettre
au salarié une notice d'information, et le défaut d'information est sanctionné de la
même manière par l'inopposabilité au salarié de la réduction des garanties et par
la responsabilité de l'employeur. La remise de cette notice n'est pas nécessaire en
cas de suppression du régime, mais les salariés et les représentants du personnel
doivent être informés.
Éviter les discordances
Dans tous les cas, la mise en œuvre de la modification ou de la suppression du régime
implique que la modification ou la résiliation, selon le cas, du contrat d'assurance et
la modification ou la dénonciation de l'acte juridique fondateur aillent ensemble.
L'une ne peut pas aller sans l'autre. En effet, en cas de modification ou de résiliation du contrat d'assurance, sans toucher à l'acte fondateur, l'employeur resterait
tenu de verser aux salariés les prestations prévues par cet acte, l'organisme assureur
n'ayant plus d'obligations à cet égard. Et, inversement, en cas de modification ou de
dénonciation de l'acte fondateur sans toucher au contrat d'assurance, l'employeur,
n'ayant plus le droit d'en précompter la part salariale, resterait tenu de verser seul
les cotisations prévues par ce contrat. Il est donc particulièrement important de s'assurer d'une corrélation parfaite entre la durée de la norme collective applicable dans
l'entreprise et celle du contrat d'assurance.
