II. Modification ou résiliation du contrat
d'assurance
A. Résiliation à l'échéance
L'employeur comme l'organisme assureur peuvent résilier le contrat tous les ans
(C. assur., art. L. 113-12, art. L. 145-8 ; CSS, art. L. 932-12 ; C. mut., art. L. 221-10).
La résiliation s'exerce au moins deux mois avant la date d'échéance par lettre recommandée pour ce qui concerne les institutions de prévoyance (CSS, art. R. 932-1-6)
et par lettre recommandée ou envoi électronique recommandé pour les sociétés
d'assurance et les mutuelles (C. assur., art. L. 113-12 ; C. mut., art. L. 221-10).
Remarques
- Le point de départ du délai de deux mois est la date figurant sur le cachet de la
poste (C. assur., art. L. 113-12 ; CSS, art. R. 932-1-6. Le Code de la mutualité est muet
sur cette question).
- En l'absence de lettre recommandée, une lettre simple ne peut avoir pour effet de
permettre la résiliation du contrat (V. Cass. 2e civ., 1er juill. 2003, n° 00-16147).
Cette faculté est toutefois écartée :
- lorsque l'adhésion résulte d'une obligation prévue dans une convention ou un
accord de branche, professionnel ou interprofessionnel ;
- pour les opérations d'assurance sur la vie (C. assur., art. L. 113-12) ou dépendant de la durée de la vie humaine qui comportent une valeur de rachat (CSS,
art. L. 932-12, al. 3 ; C. mut., art. L. 223-27, al. 1). Selon la jurisprudence, en
revanche, la faculté de résiliation s'applique aux contrats d'assurance mixte
(décès, incapacité, maladie) (Cass. 1re civ., 11 oct. 1988, n° 87-13685).
Résiliation à tout moment
Dans la continuité de la loi du 17 mars 2014 pour les contrats d'assurances multirisques habitation, responsabilité civile et automobile, une loi relative au droit de
résiliation sans frais à tout moment après la première année de souscription des
contrats de complémentaire santé a été adoptée (L. n° 2019-733, 14 juill. 2019). Elle
concernera les contrats proposés par tous les organismes assureurs (C. assur., art.
L. 113-15-2 ; CSS, art. L. 932-12-1 et L. 932-12-2 nouv. ; C. mut., art. L. 221-10).
La demande de résiliation prendra effet un mois après réception par l'organisme de
la notification par l'assuré.
Un décret en Conseil d'État devra déterminer les modalités de mise en œuvre de cette
nouvelle faculté de résiliation qui devrait s'appliquer à partir du 1er décembre 2020.
