B. Résiliation anticipée
La résiliation du contrat avant l'échéance intervient en règle générale à l'initiative
de l'organisme assureur en cas de non-paiement de la prime ou de la cotisation
(C. assur., art. L. 141-3 ; CSS, art. L. 932-9 ; C. mut., art. L. 221-8).
Harmonisation
Tous les organismes assureurs sont soumis à l'interdiction de suspendre ou résilier
le contrat lorsqu'il résulte d'une obligation prévue par une convention collective
de branche ou un accord collectif professionnel ou interprofessionnel (C. assur.,
art. L. 113-3 ; CSS, art. L. 932-9 ; C. mut., art. L. 221-8), ou lorsque le contrat concerne
les opérations d'assurance sur la vie (C. assur., art. L. 132-20) ou dépendant de la vie
humaine comportant une valeur de rachat (CSS, art. L. 932-9, al. 6).
Elle suppose le respect d'une procédure spéciale variant en fonction de l'organisme
assureur concerné qui débute, dans tous les cas, par une mise en demeure adressée
à l'entreprise.
En ce qui concerne les sociétés d'assurance, lorsque la prime n'a pas été payée dans
les dix jours de son échéance, l'organisme assureur adresse à l'employeur une lettre
recommandée par laquelle il l'informe qu'à l'expiration d'un délai de quarante
jours à dater de l'envoi de cette lettre le défaut de paiement entraîne la résiliation
du contrat (C. assur., art. L. 132-20). La résiliation sera alors effective à l'expiration
de ce dernier délai (C. assur., art. L. 141-3).
Les institutions de prévoyance et les mutuelles doivent mettre en demeure l'employeur qui n'a pas payé les cotisations dans les dix jours de l'échéance, la résiliation du contrat ne pouvant intervenir que dix jours après l'expiration d'un délai
de trente jours après cette mise en demeure (CSS, art. L. 932-9 et R. 932-1-5, al. 2 ;
C. mut., art. L. 221-8).
La lettre de mise en demeure adressée par l'institution de prévoyance et par la
mutuelle doit également préciser à l'entreprise les conséquences du non-paiement
(CSS, art. L. 932-9, al. 2 ; C. mut., art. L. 221-8).
La mutuelle doit, en plus, informer le membre participant - c'est-à-dire le salarié
- qu'à l'expiration du délai de trente jours, le défaut de paiement de la cotisation
par l'employeur est susceptible d'entraîner la résiliation du bulletin d'adhésion ou
du contrat collectif, sauf s'il entreprend de se substituer à l'employeur (C. mut.,
art. L. 221-8, I, al. 2).
