La protection sociale complémentaire d'entreprise
Le même décret détermine les conditions dans lesquelles est constatée la remise des
documents mentionnés aux alinéas précédents.
Article L. 932-4
L'adhérent doit :
1° Payer la cotisation due aux époques convenues ;
2° Répondre exactement aux questions de l'institution de prévoyance relatives au
groupe qu'elle envisage de garantir, notamment lorsque celle-ci l'interroge lors de la
signature du bulletin d'adhésion au règlement ou lors de la souscription du contrat sur
la nature des activités de l'entreprise, l'importance du groupe ou ses caractéristiques
socio-démographiques ;
3° Déclarer en cours d'adhésion ou de contrat tout nouveau salarié qui répond aux
conditions définies par le règlement et le bulletin d'adhésion ou par le contrat.
Les dispositions mentionnées au 1° ci-dessus ne sont pas applicables aux opérations dépendant de la durée de la vie humaine qui comportent une valeur de rachat.
Article L. 932-5
Lorsque, avant l'adhésion ou la souscription, l'institution de prévoyance a posé des questions par écrit au participant, notamment par un formulaire de déclaration du risque
ou par tout autre moyen, elle ne peut se prévaloir du fait qu'une question exprimée en
termes généraux n'a reçu qu'une réponse imprécise.
Article L. 932-6
L'institution de prévoyance établit une notice qui définit les garanties souscrites par
contrat ou par adhésion à un règlement et leurs modalités d'entrée en vigueur, ainsi que
les formalités à accomplir en cas de réalisation du risque. Elle précise également le contenu des clauses édictant des nullités, des déchéances ou des exclusions ou limitations de
garantie ainsi que des délais de prescription.
L'adhérent est tenu de remettre cette notice à chaque participant.
Lorsque des modifications sont apportées aux droits et obligations des participants, l'adhérent est également tenu d'informer chaque participant en lui remettant une notice
établie à cet effet par l'institution.
La preuve de la remise de la notice au participant et de l'information relatives aux modifications contractuelles incombent à l'adhérent.
Article L. 932-7
Lorsque la réticence ou la fausse déclaration intentionnelle du participant change l'objet du risque ou en diminue l'opinion pour cette institution, alors même que le risque
omis ou dénaturé par le participant a été sans influence sur la réalisation du risque, la
garantie accordée par l'institution à ce participant est nulle.
Les cotisations payées à ce titre demeurent acquises à l'institution.
