Les modes de déclaration
En fonction du mode d'exercice (régime micro ou régime dit de la déclaration contrôlée), des déclarations différentes sont à effectuer.
LES BNC AUTO-ENTREPRENEURS ET LE RÉGIME MICRO BNC
Le régime que l'on appelle micro ou auto-entrepreneur regroupe en réalité
deux régimes : un régime fiscal, celui du micro BNC, et un régime social,
celui du micro social :

Le régime auto-entrepreneur est intéressant pour sa simplicité et pour l'absence de cotisations sociales exigibles en absence de chiffre d'affaires. En
effet, la base de cotisation et/ou d'imposition des régimes dits « micro » est
le chiffre d'affaires encaissé. Il n'y a pas, contrairement au régime de base,
d'appels provisionnels forfaitaires de cotisations. On a donc : zéro chiffre
d'affaires = zéro cotisations sociales.
Toutefois, il est souvent - dès que les charges réelles (qui comprennent les
cotisations sociales) sont supérieures à 34 % de CA - moins avantageux
que le réel (régime de la déclaration contrôlée).
Certaines activités sont actuellement incompatibles avec le statut auto-entrepreneur. En effet, les auto-entrepreneurs relevant du régime des BNC
cotisent obligatoirement à la CIPAV pour la retraite. Or, l'exercice de certaines professions réglementées dépend d'une autre caisse : CAVEC pour
les experts-comptables et commissaires aux comptes, CARMF pour les
médecins, etc. Ces professionnels ne peuvent donc pas exercer en tant
qu'auto-entrepreneurs. Le régime fiscal micro-BNC est en revanche possible pour tous.
