Autrement dit :
- pour la réalisation du diagnostic amiante avant travaux, la norme NF X 46-020 reste le référentiel
; elle est réputée satisfaisante, mais non obligatoire ;
- le repérage amiante avant travaux doit permettre d'attester de la présence d'amiante. Il doit donc
être réalisé sur tous les matériaux ou produits susceptibles de contenir de l'amiante (MPSCA) et
affectés directement ou indirectement par les travaux. Le périmètre à diagnostiquer s'élargit donc
aux matériaux pouvant être affectés indirectement par les travaux (suite à des chocs ou des vibrations
pouvant émettre des fibres d'amiante, par exemple) ;
- pour réaliser un diagnostic amiante, l'opérateur devra être certifié avec mention. Il devra également
justifier de sa formation à la prévention du risque amiante et de la validation de ses processus
de prélèvement conformément aux dispositions du Code de la santé publique ;
- les déchets amiante devront être quantifiés. L'opérateur devra s'appuyer sur les dispositions
en vigueur pour le diagnostic déchets afin de proposer une estimation des quantitatifs (mètres linéaires,
poids, surface...) des matériaux contenant de l'amiante repérés dans le périmètre travaux.
Cette obligation doit permettre aux maîtres d'ouvrage d'anticiper la gestion des déchets amiante ;
- la pénalisation pour absence d'un diagnostic amiante avant travaux ou pour un repérage non
conforme entre en application. Ainsi, des peines allant de 4 500 € à 9 000 € d'amende et jusqu'à
1 an et demi d'emprisonnement peuvent maintenant être prononcées ;
- des dérogations à la réalisation du RAT amiante existent et sont confirmées :
* impossibilité de mener à bien le repérage ; on considère alors que l'amiante est présent partout
et qu'une protection adaptée devra être mise en œuvre,
* substitution du DTA ou du DAPP déjà existant au DAAT, à condition que tous les matériaux ou
produits contenant de l'amiante (MPCA) susceptibles d'être impactés aient été intégralement
visés dans le dossier.
Le repérage doit donc être exhaustif. Ainsi, il est confirmé que si un dossier technique amiante est
complet et mis à jour régulièrement, il peut remplacer les repérages répétitifs. Sur ce dernier point,
il est intéressant de noter l'importance que peut avoir le DTA : bien réalisé, complet ou même élargi
dès sa création, il peut en effet permettre de réaliser de nombreuses économies sur les travaux
futurs.
