B. SECOND CAS : LES TRAVAUX SONT RÉALISÉS PAR UN PARTICULIER
Afin d'identifier la présence d'amiante, le propriétaire peut consulter les informations dont il
dispose déjà (documents sur l'année de construction ou diagnostics amiante... Il est fortement
conseillé de compléter ces informations avec un RAT, afin d'identifier la présence éventuelle de
composants amiantés inaccessibles.
Toute intervention portant sur des matériaux ou produits amiantés est fortement déconseillée. Il
est recommandé de faire intervenir des professionnels formés à la prévention des risques liés aux
travaux portant sur l'amiante.
Toutefois, dans le cas où un particulier réaliserait ses propres travaux, il devient responsable des
éventuelles conséquences pour lui-même et son voisinage. Il est alors notamment recommandé :
- de porter une combinaison et des gants jetables ;
- de s'équiper d'un masque FFP3 ;
- d'humidifier le matériau ou le produit pour limiter la dispersion de fibres, voire d'utiliser une
poche de gel hydrique pour perçage ;
- de préférer les outils manuels aux outils électriques, qui produisent beaucoup de poussières ;
- de couvrir les surfaces avant l'intervention et de déplacer des meubles en dehors de la zone de
travail, puis de nettoyer les surfaces et le matériel avec un chiffon humide après l'intervention.
Point de vigilance
Ayant relevé que l'importance des travaux de rénovation réalisés par le vendeur
les assimilait à des travaux de construction d'un ouvrage, la cour d'appel en a
exactement déduit que le vendeur était responsable de plein droit des dommages
constatés sur le fondement de l'article 1792 du Code civil (Cass. 3e
3 mars 2010, n° 09-11282).
