LE MÉTIER
En application de cet article, le diagnostiqueur :
- doit être certifié par un organisme accrédité COFRAC ;
- est tenu de souscrire une assurance permettant de couvrir les conséquences d'un engagement
de sa responsabilité en raison de ses interventions ;
- ne doit avoir aucun lien de nature à porter atteinte à son impartialité et à son indépendance, ni
avec le propriétaire ou son mandataire qui fait appel à elle, ni avec une entreprise pouvant réaliser
des travaux sur les ouvrages, installations ou équipements pour lesquels il lui est demandé d'établir
un diagnostic.

Il y a donc des conditions d'accès à la profession (section 1) qui permettent l'exercice de la profession
(section 2).
Section 1. L'accès à la profession
64. L'exercice de la profession de diagnostiqueur immobilier est encadré par la loi. Seuls les diagnostiqueurs
certifiés sont habilités à réaliser des diagnostics. Ils doivent en effet satisfaire à des
obligations réglementaires de formation et de certification individuelle.
Les diagnostiqueurs ont une obligation de formation initiale et continue, dispensée par des organismes
de formation certifiés, dans les domaines d'activité qu'ils proposent.
Les métiers de diagnostiqueur impliquent en effet :
- la nécessité de se tenir à jour des dernières évolutions législatives et réglementaires ; cela
crée pour le diagnostiqueur une pression renforcée par le risque juridique pesant sur lui en cas de
non-respect de ces dispositions ;
- des aptitudes à comprendre et intégrer les paramètres des nouvelles technologies (nouveaux
procédés, nouveaux matériaux...).
De la même façon, la certification des diagnostiqueurs est délivrée spécifiquement pour chacun
des diagnostics obligatoires, par des organismes accrédités par le COFRAC. Cette certification est
obtenue après le passage d'un examen théorique et pratique, spécifique à chaque type de diagnostic.
Elle doit être renouvelée tous les 5 ans et soumise à contrôle lors de ces 5 années.
Il sera ainsi distingué entre la certification (I) et la formation (II).
