LE MÉTIER
La faute dolosive, quant à elle, est un scénario prémédité, un dessein de l'assuré. Il faut donc
rapporter la double preuve :
- de l'élément subjectif correspondant à un comportement délibéré de l'assuré ;
- de l'élément objectif correspondant à la disparition de l'aléa.
L'affaire semble entendue : la théorie dualiste des fautes volontaires inassurables a été consacrée.
La faute dolosive et la faute intentionnelle restent donc deux notions autonomes.

84. Il peut, également, être stipulé des exclusions.
Exemple de clause d'exclusion dans une police
Ce contrat ne s'applique pas aux activités suivantes de :
- Géomètre expert
- Contrôleur technique (CCH, art. L. 111-24)
- Analyste de matériaux et produits
- Définition et/ou mise en place de labels, normes, qualifications, certifications
- Entrepreneur, constructeur, intervenant dans l'acte de construction ou d'entretien de biens
immobiliers
- Traitement de l'amiante en place
- Promoteur immobilier
- Marchand de biens
- Agent immobilier
- Expert dans le domaine des atteintes à l'environnement
- Les missions d'administrateur judiciaire et/ou mandataire liquidateur judiciaire

L'assureur
et l'assuré peuvent conventionnellement exclure des risques. Par exemple, est fréquemment
exclu d'une police d'assurance de responsabilité civile le coût du produit ou de la prestation
de l'assuré. L'article L. 113-1, aliéna 1er
du Code des assurances autorise parfaitement les parties
au contrat à exclure certains risques. Mais, pour reprendre la lettre de ce texte, l'exclusion, pour
être valable, doit être formelle, limitée et, pour y ajouter la condition jurisprudentielle ajoutée incidemment
prévue à l'article L. 112-4 du même code, être écrite en caractères très apparents dans
la police, outre qu'elle ne doit pas dénaturer cette dernière.
