Dès lors, si l'assureur oppose un refus de garantie à l'appui d'une exclusion prévue dans la police,
l'assuré pourra contester ce refus en contestant la validité de la clause d'exclusion.
La question relève de la libre appréciation des juges du fond, mais la Cour de cassation opère un
contrôle de motivation. La jurisprudence récente illustre la fréquence et la variété des contentieux
sur la question de la validité des clauses d'exclusions. Les dernières décisions sont résumées dans

ni limitée
* D'une part, l'expression « pratique d'un sport » est peu
précise et, d'autre part, la conduite d'un engin à moteur
peut intervenir dans le cadre de déplacements privés
