elle est claire et ne laisse place à aucune interprétation
quant à la volonté des parties d'écarter la garantie dans
une hypothèse particulière

Le principe de réparation intégrale du préjudice se heurte ici à une limite de taille. Les parties
peuvent librement convenir de fixer des limites à l'indemnisation. Autrement dit, le plafond de
garantie est le montant maximal que l'assureur accepte de garantir pour le risque couvert. Ces
plafonds de garantie peuvent être légaux, réglementaires ou contractuels.
Ces limitations peuvent aussi dépendre du nombre de sinistres survenus ou du nombre d'années
d'assurances, ou les deux.
