I. La responsabilité contractuelle
92. Le contractant va devoir qualifier la faute du diagnostiqueur, démontrer un préjudice et établir
le lien de causalité existant entre cette faute et ce préjudice. Ce triptyque, qui semble difficile à
prouver, paraît toutefois largement appréhendé par les juges (A).
Cette facilitation des recours exercés à l'encontre des diagnostiqueurs est encore accentuée par les
sanctions spécifiques, introduites par le législateur pour certains diagnostics (B).
A. LES CAS COMMUNS
93. Dans un arrêt du 8 décembre 20161
, la haute juridiction a estimé que le diagnostiqueur qui
voyait sa responsabilité engagée en cas de faute commise dans l'exercice de sa mission était tenu
de réparer l'intégralité des préjudices dès lors qu'ils revêtaient un caractère certain.
La question de l'étendue du préjudice réparable est en effet une question centrale. Le diagnostiqueur
doit-il indemniser uniquement la perte de chance d'acquérir et/ou de vendre le bien à un
meilleur prix ? Le diagnostiqueur peut-il être condamné à payer, en tout ou partie, le coût des
travaux réparatoires ?
La chambre mixte de la Cour de cassation a tranché cette question par un arrêt en date du 8 juillet
2015, aux termes duquel elle a estimé que les préjudices matériels et de jouissance subis par l'acquéreur
du fait du diagnostic erroné avaient un caractère certain et devaient donc être indemnisés2
