* Une SCI avait acheté un ensemble
immobilier à usage
de bureaux à une société (le
vendeur)
* Un premier rapport du diagnostiqueur
avait été réalisé
le 30 avril 2004, avant cette
vente, et faisait état de présence
d'amiante
* Un autre diagnostic a été
réalisé en 2017 mettant en
lumière la présence d'amiante
préalablement non révélée
* La cour d'appel retient que
le vendeur ainsi que les diagnostiqueurs
ont commis des
fautes ayant abouti au préjudice
de la victime et engendré
des travaux supplémentaires
* Par conséquent, il s'agit
d'une responsabilité in solidum
*
Elle prévoit notamment que
« la responsabilité du diagnostiqueur
étant retenue sur
la base de fautes spécifiques
ayant concouru à la réalisation
du dommage »

contacté une société
spécialisée
* Celle-ci lui a indiqué
que sa toiture n'était
pas en ardoise et
qu'elle était sûrement
amiantée
* Un nouveau diagnostic
a donc été effectué
et a confirmé la présence
d'amiante
* Un devis pour chiffrer
le désamiantage a été
réalisé
Solution
Le tribunal retient que
la société, étant professionnelle,
ne peut prétendre
qu'à une perte
de chance de ne pas
avoir su plus tôt qu'elle
allait devoir payer les
frais de désamiantage
