que le diagnostiqueur
avait commis une faute
dans l'accomplissement
de sa mission à l'origine
d'une mauvaise appréciation
de
la
qualité
énergétique
du bien, la
cour d'appel en a déduit
à bon droit que le
préjudice subi par l'acquéreur
du fait de cette
information erronée ne
consistait pas dans le
coût des travaux d'isolation
des
térieurs
et
murs
exintérieurs,
mais
en une perte de
chance de négocier une
réduction du prix de
vente ou de renoncer à
l'achat »
94. Bien entendu, la responsabilité du diagnostiqueur ne peut pas être recherchée si ce dernier a
réalisé sa mission conformément aux dispositions légales et aux règles de l'art.
Point de vigilance
Ce principe est très important et renouvelle la question de la contractualisation
des normes et règles de l'art ainsi que la définition précise des investigations
faites par le diagnostiqueur.
En 2011, dans un arrêt relatif à la détection de l'amiante3
, la Cour de cassation a écarté la responsabilité
du diagnostiqueur en estimant que « la société H. avait réalisé son diagnostic avec une
mission conforme à l'arrêté du 22 août 2002 qui précise que l'opérateur recherche et constate de
visu la présence de matériaux et produits accessibles sans travaux destructifs, et qu'il n'était pas
démontré que la présence d'amiante était perceptible par un simple examen visuel ».
Le même raisonnement a été mis en œuvre dans une espèce portant sur un état parasitaire dans
un arrêt du 15 novembre 20114
.
Toutefois, le diagnostiqueur ne saurait dégager sa responsabilité en se retranchant derrière une intervention
a minima d'un arrêté ou, plus généralement, d'une norme ou d'un texte réglementaire.
