Si la superficie est supérieure à celle exprimée dans l'acte, l'excédent de mesure ne donne lieu
à aucun supplément de prix.
Si la superficie est inférieure de plus d'un vingtième à celle exprimée dans l'acte, le vendeur, à la
demande de l'acquéreur, supporte une diminution du prix proportionnelle à la moindre mesure.
L'action en diminution du prix doit être intentée par l'acquéreur dans un délai d'un an à compter
de l'acte authentique constatant la réalisation de la vente, à peine de déchéance. »

selon une attestation
d'un diagnostiqueur
* Cependant, une seconde
attestation a
été établie par la suite,
indiquant une surface
bien inférieure
* Le particulier ayant
vendu ce bien a donc
assigné le diagnostiqueur
qui avait réalisé
un mauvais rapport
* Par acte d'huissier en
date du 12 juin 2019,
l'acquéreur a fait assigner
le vendeur devant
le TJ de Pau, aux fins
de le voir condamner
à lui régler la somme
de 9 260 € avec intérêts,
outre la somme
de 5 000 € à titre de
dommages et
intérêts
et de 2 500 € au titre
des frais de procédure
Solution
La cour d'appel retient
que si
le calcul de la
surface habitable qui
doit être indiqué dans
l'acte de vente d'un
bien n'est pas soumis
à l'obligation de recourir
à un diagnostiqueur
professionnel, dès lors
que l'acquéreur a sollicité
un diagnostiqueur
pour calculer la surface
de son studio en vue
de sa vente, et que celui-ci
a délivré une attestation
de superficie
visant expressément la
loi Carrez, ce diagnostiqueur
a engagé sa responsabilité
pour l'erreur
de mesurage effectué,
sans qu'il soit besoin de
rechercher sa faute, la
simple erreur matérielle
ayant conduit à délivrer
une attestation erronée
suffit à engager sa responsabilité,
l'obligation
de ce professionnel
étant, de jurisprudence
constante, une obligation
de résultat
