loi du 18 décembre
1996, l'acte de vente
mentionnait que la superficie
privative des
lots était de 121,68 m2
selon
le
Judiciaire

mesurage du 20 janvier
2003 établi par la société
Newton
* Souhaitant
vendre
leur bien, les consorts
ont demandé à la société
Newton un nouveau
certificat de mesurage,
qui a été établi le 29
septembre 2005 pour
une surface effective
de 77,45 m2
seulement
* Les consorts ont alors
assigné la société
La Cour de cassation
retient le préjudice subi
par
l'acquéreur
ainsi
que la responsabilité du
diagnostiqueur dû à son
erreur de mesurage
La cour considère en
effet, comme le soutenait
le mesureur, que,
dans ce cas, le préjudice
invoqué par l'acquéreur
n'est
pas la
conséquence d'une erreur
de mesurage, mais
résulte du fait que l'acquéreur
n'a pas engagé
son action dans le délai
de rigueur
