II. La responsabilité extracontractuelle
96. Aux deux grands types de diagnostics, avant-vente ou avant-travaux, répondent les grands
recours qui peuvent être exercés par les diagnostiqueurs.
La plupart du temps, ces recours sont ceux des acquéreurs, qui pensent découvrir termites, mérules,
insuffisances thermiques et autres amiantes ou plomb (A). Mais ils peuvent également être
exercés par les constructeurs qui découvrent des zones contaminées lors de la réalisation de travaux
et sollicitent des surcoûts et délais supplémentaires (B).
Chaque cas fera l'objet d'un développement distinct.
A. L'ACQUÉREUR
97. C'est là tout l'objet de la première partie de ce livre : le vendeur et le bailleur ont l'obligation
de faire réaliser plusieurs diagnostics préalablement à la vente ou la location.
À l'évidence, les conséquences de la non-fourniture de ce diagnostic à l'occasion d'une vente sont
bien plus importantes.
Pour s'assurer du respect de cette obligation par le vendeur, il a été prévu une sanction efficace :
à défaut de communiquer certains de ces diagnostics, le vendeur ne pourra pas se prévaloir de la
clause d'exonération de la garantie des vices cachés.
Un peu d'exégèse ne fait jamais de mal
C. civ., art. 1641
« Le vendeur est tenu de la garantie à raison des défauts cachés de la
chose vendue qui la rendent impropre à l'usage auquel on la destine, ou
qui diminuent tellement cet usage que l'acheteur ne l'aurait pas acquise,
ou n'en aurait donné qu'un moindre prix, s'il les avait connus. »
Dans la très grande majorité des actes de vente, il est stipulé une clause qui permet au vendeur
d'échapper à la garantie des vices cachés. L'acquéreur déclare accepter le bien en l'état.
C'est la raison pour laquelle les recours de l'acquéreur à l'égard du diagnostiqueur se multiplient.
