par un diagnostiqueur
ne révélant pas la présence
d'amiante
* Reprochant aux vendeurs
d'avoir

sciemdissimulé
ces

ils ont saisi le juge des
référés, qui a ordonné
une expertise

par la suite assigné le
vendeur
ainsi que le
diagnostiqueur en justice,
et le tribunal de
Castres les a condamnés
in solidum en réparation
du préjudice
* Appel a été interjeté
* À propos de la responsabilité
du diagnostiqueur,
la cour d'appel
retient que la responsabilité
du diagnostiqueur
se trouve engagée
lorsque le diagnostic n'a
pas été réalisé conformément
aux normes
édictées et aux règles
de l'art, et qu'il se révèle
erroné
* Le diagnostiqueur
engage donc sa responsabilité
civile délictuelle
en omettant de
mentionner dans son
rapport
la présence
d'amiante alors que
celle-ci était détectable
sans travaux destructifs
* De plus, il ressort du
rapport que le diagnostiqueur
n'a pas mentionné
une certaine
partie du toit
