B. LE CONSTRUCTEUR
98. L'hypothèse classique est celle d'un maître d'ouvrage qui va solliciter un diagnostic dans la
perspective de réalisation de travaux. Dans l'exemple d'un diagnostic amiante, le marché de l'entreprise
est établi par le maître d'œuvre sur la base du repérage réalisé. L'entreprise commence
ses travaux et découvre de l'amiante. Elle demande une rémunération supplémentaire pour désamianter
ce qui, selon elle, aurait dû être mentionné dans le diagnostic.
Point de vigilance
Cette problématique, récurrente sur les chantiers notamment de désamiantage,
renouvelle l'opportunité de bien définir, dans le contrat, l'étendue de l'examen
visuel, de contractualiser la norme applicable et de définir le plus précisément
possible la méthodologie d'investigations.
Il peut également être utile d'émettre des réserves dans les rapports.

par une partie de ses
engagements
contractuels
