Section 2. Les recours du diagnostiqueur
100. Le diagnostiqueur n'est pas pour autant démuni en cas de contentieux. Selon la nature du
diagnostic, il peut exercer un recours, en amont, à l'encontre des prestataires auxquels il recourt
pour réaliser son diagnostic (I) et, en aval, à l'encontre des professionnels qui régularisent les actes
pour lesquels le diagnostic a été sollicité (II).
I. En amont : le laboratoire d'analyse
101. Le laboratoire d'analyse est celui qui va analyser une partie du prélèvement qui lui est confié
par le diagnostiqueur. Comment choisit-il la partie du prélèvement à analyser ? Est-il responsable
de son choix ? La jurisprudence est assez sévère à son encontre, ce qui conduira, après avoir abordé
le principe de sa mise en cause (A), à examiner des décisions récentes pour en saisir la mise
en œuvre (B).
A. LE PRINCIPE
102. Alors que certains diagnostics procèdent d'un simple examen visuel, d'autres s'accompagnent
de prélèvements. Dans ce dernier cas, le diagnostiqueur est libre de déterminer - dans le respect,
bien entendu, des règles de l'art et d'autres normes pouvant guider ses choix - l'endroit du prélèvement
et la quantité à prélever. Autrement dit, il est responsable de son prélèvement.
Il reste que ce prélèvement, aussi petit soit-il au regard de la zone considérée, peut lui aussi
être hétérogène. Autrement dit encore, le diagnostiqueur peut prélever dans un endroit où, par
exemple, un risque d'amiante lui paraît possible puis, après avoir transmis le prélèvement au laboratoire,
découvrir que le résultat est négatif alors qu'à un autre endroit du prélèvement, qui n'aurait
pas été analysé, ils peuvent être positifs.
La question de la mise en cause de la responsabilité du laboratoire d'analyse est ainsi de plus en
plus fréquente en pratique, notamment pour les contentieux liés à l'amiante, à propos de locaux qui
auraient été mal décontaminés ou dans lesquels tout l'amiante n'aurait pas été identifié.
