* Ce désamiantage a pris
place dans le cadre d'une
opération immobilière comprenant
la
cession de l'immeuble

Ont été réalisés une recherche
de matériaux amiantifères
et un diagnostic d'état
de conservation des flocages
et
calorifugeages contenant
de l'amiante
* Un rapport a été rendu,
signalant notamment que le
plan du bâtiment indiquait la
présence de flocages amiantés
recouvrant les parements
de façades et précisant que
ces
flocages n'étaient

* Ce rapport a été complété
le 17 décembre 1996 par un
second rapport ayant trait à
une commande particulière
portant
sur deux prélèveet
30e étages sur des
ments ponctuels effectués
aux 29e
éléments de façade rendus
apparents par des travaux,
indiquant que, selon l'analyse
faite, le revêtement de ces
éléments ne contenait pas
d'amiante
* Postérieurement, dans le
cadre d'une préparation de
la vente de l'immeuble, les
maîtres de l'ouvrage ont
confié à une société un diagnostic
de la tour en vue de
sa réhabilitation - lequel
diagnostic ne comportait pas
d'investigations de recherche
d'amiante - et ont fait procéder
au curage et au désamiantage
complet de l'étage
Solution
* Les parties invoquaient
comme moyen le fait que
l'expert avait suffisamment
caractérisé les fautes commises
par le laboratoire,
ayant observé en outre que
ce dernier
n'avait
pas
les
compétences requises (cartographie
imprécise des
prélèvements, méthode inadaptée
au matériau à analyser,
manque de perspicacité),
puisque la découverte
d'amiante dans deux autres
échantillons de blackson
prélevés à d'autres endroits
aurait
impérativement
dû
amener à des analyses complémentaires

En l'absence de tout plan
de désamiantage établi à
l'avance avec rigueur, les
fautes ainsi commises ont
contribué à l'adoption d'une
méthodologie inappropriée
en asseyant
la conviction
trop vite acquise des intervenants
quant à la neutralité
du blackson revêtant les tôles
de façade
* Le laboratoire a donc engagé
sa responsabilité
* Le tribunal judiciaire a alors
retenu la responsabilité du
laboratoire d'analyse in solidum
