B. L'AGENT IMMOBILIER
107. L'agent immobilier est concerné au même titre que le notaire.
Il est clairement établi, selon une jurisprudence abondante et constante, que dans l'exercice de sa
profession, l'agent immobilier peut être « responsable du dommage subi par toutes les personnes
parties à l'opération dont l'échec est imputable à ses fautes professionnelles, le fondement de cette
responsabilité étant contractuel à l'égard de ses clients et délictuel à l'égard des autres parties »7
.
Il existe trois grandes catégories d'engagement de la responsabilité de l'agent immobilier :
- 1er
cas : le manquement à son obligation de moyens dans l'accomplissement de sa mission. Par
exemple, en matière de bail, l'agent immobilier est tenu de s'assurer de la solvabilité des locataires8
ainsi que de celle des cautions9
, ou encore de la souscription par le locataire d'une assurance10
;
- 2e cas : le manquement à son obligation de résultat en sa qualité de rédacteur d'acte. À titre
illustratif, il peut s'agir de l'inefficacité d'un acte de cautionnement faute de l'inscription dans
