II. Le diagnostic bruit
14. En application de l'article 3-3 de la loi n° 89-462 du 6 juillet 1989, le dossier de diagnostic,
fourni par le bailleur, comprend, lorsque le bien est situé dans l'une des zones de bruit définies par
un plan d'exposition au bruit des aérodromes prévu par l'article L. 112-6 du Code de l'urbanisme,
un document comportant l'indication claire et précise de cette zone ainsi que les autres informations
prévues par l'article L. 112-11 du même code.
Le premier sujet d'information est donc l'exposition au bruit des aérodromes, mais ce n'est pas
tout.
L'article L. 112-11 du Code de l'urbanisme prévoit que lorsque les immeubles bâtis sont à usage
d'habitation ou à usage mixte professionnel et d'habitation ainsi que les immeubles non bâtis
constructibles situés dans l'une des zones de bruit définies par un plan d'exposition au bruit font
l'objet d'une location, le locataire doit être informé de cette situation.
Dans le domaine de la vente, le diagnostic « Bruit » est donc un document qui permet de faire
connaître au futur acquéreur l'existence de nuisances sonores aériennes. Il est annexé à la promesse
de vente ou, à défaut de promesse, à l'acte authentique de vente.
Ce devoir d'information se réalise concrètement par la transmission d'un document qui comporte :
- l'indication claire et précise de la zone ;
- l'adresse du service d'information en ligne permettant de consulter le plan d'exposition au bruit ;
- la mention de la possibilité de consulter le plan d'exposition au bruit à la mairie de la commune
de l'immeuble.
Ce document est donc directement établi par le bailleur et/ou le vendeur.
Le plan d'exposition au bruit (PEB) est consultable sur le site Géoportail de l'Institut national de
l'information géographique et forestière (IGN).
Le PEB est un document opposable aux tiers qui s'impose au PLU des communes. Il vise à organiser
l'urbanisation proche des aérodromes en préservant l'activité aéroportuaire. Il a pour objet de permettre
un développement maîtrisé des communes sans exposer au bruit de nouvelles populations
et fixe les conditions d'utilisation des sols exposés aux nuisances dues au bruit des aéronefs.
Les zones de bruit des aérodromes sont classées en zones de bruit : zone A et zone B pour un
bruit fort, zone C et le cas échéant zone D pour un bruit modéré. Chaque zone correspond à des
prescriptions, des restrictions ou des interdictions spécifiques.
