LES DIAGNOSTICS LIÉS À LA TRANSLATION DE LA PROPRIÉTÉ
À défaut, le préfet peut mettre en demeure le propriétaire ou l'exploitant d'établir un diagnostic
ou de mettre en œuvre les mesures nécessaires au contrôle ou à la réduction de l'exposition à
l'amiante. Il est également autorisé, à l'expiration du délai de mise en demeure et si aucune mesure
prescrite n'a été prise, à suspendre l'accès et l'exercice de toute activité dans les locaux.
L'article 3-3 de la loi n° 89-462 du 6 juillet 1989 tendant à améliorer les rapports locatifs et
portant modification de la loi n° 86-1290 du 23 décembre 1986 précise que dans le dossier de
diagnostic technique fourni par le bailleur doit figurer la copie d'un état mentionnant l'absence ou,
le cas échéant, la présence de matériaux ou produits de la construction contenant de l'amiante.
23. Depuis un décret n° 2011-629 du 3 juin 2011, entré en vigueur au 1er
distingué entre les propriétaires de maison individuelle, les propriétaires de parties privatives et/
ou de parties communes d'immeubles collectifs d'habitation ainsi que les propriétaires d'autres
bâtiments.
Les bâtiments devant être diagnostiqués sont toujours les immeubles dont le permis de construire
a été délivré avant le 1er
juillet 1997.
B. MATÉRIAUX CONTENANT DE L'AMIANTE
Les matériaux contenant de l'amiante devant faire l'objet de diagnostics sont regroupés sous trois
listes :
- une liste A pour les flocages, calorifugeages et faux plafonds (1) ;
- une liste B pour les matériaux examinés anciennement dans le cadre du dossier technique
amiante (2) ;
- une liste C pour ceux recherchés dans le cadre du diagnostic avant démolition (3).
1. Les matériaux de la liste A
Ils sont à rechercher, de façon obligatoire, sous peine d'une amende de 5e
classe, par les propriétaires
d'immeubles bâtis, qu'ils soient personnes publiques ou personnes privées. Cette recherche
n'est, toutefois, obligatoire qu'en cas de vente. Si le propriétaire des bâtiments autres que d'habitation
n'est pas identifiable, l'obligation incombe à l'exploitant de l'immeuble.
Le repérage des matériaux et produits de la liste A s'impose à tous les immeubles bâtis dont le
permis de construire a été délivré avant le 1er
juillet 1997, excepté pour les immeubles à usage
d'habitation comportant un seul logement, sauf en cas de vente.
Le contenu du repérage consiste à :
- rechercher la présence des matériaux et produits de la liste A accessibles sans travaux destructifs ;
- identifier et localiser les matériaux et produits qui contiennent de l'amiante ;
- évaluer l'état de conservation des matériaux et produits contenant de l'amiante.
