Une erreur de mesure ou l'absence de mesurage loi Boutin engage la responsabilité du bailleur ou
du mandataire de location et peut entraîner des conséquences sur le bail et le montant des loyers.
Le mesurage de la surface habitable d'un logement doit être très précis : si le locataire est en
mesure de prouver que le logement présente une surface habitable de 5 % ou moins à celle annoncée,
il peut alors demander une diminution de son loyer au prorata de la différence de surface
habitable constatée.
Cette partie sera développée dans ce livre dans un autre chapitre.
L'obligation de fourniture de la surface habitable loi Boutin a été mise en place afin de protéger les
intérêts des locataires à plusieurs titres :
- afin de pouvoir comparer le montant des loyers pratiqués au mètre carré habitable par rapport
à d'autres logements ;
- dans le but d'estimer le montant des factures en énergie par rapport à la consommation en kWh/
m2
/an telle que calculée dans le DPE ;
- depuis l'arrêté du 10 janvier 2017, pour pouvoir comparer le montant des honoraires (frais
d'agence).

« La surface et le volume habitables d'un logement doivent être de 14
mètres carrés et de 33 mètres cubes au moins par habitant prévu lors de
l'établissement du programme de construction pour les quatre premiers
habitants et de 10 mètres carrés et 23 mètres cubes au moins par habitant
supplémentaire au-delà du quatrième.
La surface habitable d'un logement est la surface de plancher construite, après déduction des
surfaces occupées par les murs, cloisons, marches et cages d'escalier, gaines, ébrasements de
portes et de fenêtres ; le volume habitable correspond au total des surfaces habitables ainsi
définies multipliées par les hauteurs sous plafond.
Il n'est pas tenu compte de la superficie des combles non aménagés, caves, sous-sols, remises,
garages, terrasses, loggias, balcons, séchoirs extérieurs au logement, vérandas, locaux communs
et autres dépendances des logements, ni des parties de locaux d'une hauteur inférieure
à 1,80 mètre. »
36. Il y a donc des différences entre les diagnostics Carrez et Boutin, qu'il ne faut donc pas
confondre.
