L'occupant ou le propriétaire a une obligation de déclaration dès lors que son bien est contaminé.
Cette déclaration va alors permettre l'identification des zones infestées.
La procédure mise en place par les articles L. 133-7 et suivants du CCH est la suivante.

III. Le diagnostic assainissement
40. Pour être rejetées dans l'environnement sans provoquer de pollution, les eaux usées issues des
habitations doivent être traitées. Ce traitement s'effectue :
- soit en station d'épuration, si le logement est raccordé au réseau d'assainissement collectif ;
- soit grâce à des installations individuelles autonomes en zone d'assainissement non collectif.
Lorsqu'un logement n'est pas raccordé au réseau public de collecte des eaux usées (15 à 20 % de
la population française), il doit être équipé d'une installation d'assainissement non collectif (IANC)
autonome. Cette installation doit faire l'objet d'un contrôle effectué par la commune, lequel donne
lieu à un diagnostic. En cas de vente, le vendeur doit annexer ce diagnostic au sein d'un dossier de
diagnostic technique (DDT) qui doit être remis à l'acquéreur.
Autrement dit, le diagnostic assainissement est, par définition, un diagnostic immobilier obligatoire
lors de la vente d'une maison non raccordée au tout-à-l'égout. Il consiste en une vérification du
fonctionnement et de l'entretien du système d'assainissement.
En application de l'article L. 1331-4 du CSP, c'est à la commune que revient la charge de contrôler
la qualité des ouvrages nécessaires pour amener les eaux usées à la partie publique du branchement
et leur bon état. En pratique, c'est le service public d'assainissement non collectif (SPANC)
qui réalise ce diagnostic.
Le diagnostic assainissement peut juger l'installation conforme ou non conforme en fonction des
différents paramètres à prendre en compte.
Il doit être fourni aux futurs acquéreurs d'un bien immobilier avant la signature chez le notaire.
