(3) Les sociétés de personnes, qui n'entrent pas dans le champ d'application
de l'IS, ont la possibilité d'opter pour l'assujettissement à l'IS. Cette option est
irrévocable ; depuis 2019, pour éviter de pénaliser ces entités, qui constateraient que
l'option ne se justifie pas eu égard leur activité, l'administration les autorise à renoncer
à cette option jusqu'au cinquième exercice suivant celui au titre duquel
l'option a été exercée.
(4) La loi en faveur de l'activité professionnelle indépendante a créé un statut unique
pour l'entrepreneur individuel, séparant les patrimoines privé et professionnel et
l'organisation de la transmission universelle de son patrimoine professionnel. Les
entrepreneurs individuels, soumis au régime réel, peuvent opter pour l'IS,
entraînant l'imposition des bénéfices à l'impôt sur les sociétés, la déductibilité des
salaires versés à l'entrepreneur et leur imposition dans la catégorie des traitements et
salaires ; seuls les résultats appréhendés par l'entrepreneur individuel seront taxés à
l'IR. L'option est irrévocable pendant 5 ans.

(*) L'option pour un régime réel d'imposition est valable un an et reconduite tacitement
chaque année pour un an.
Ces règles s'appliquent indépendamment de celles prévues en matière
de TVA. Les seuils du régime micro-BIC ne sont donc plus alignés
sur ceux de la franchise en base de TVA. Il n'est donc plus nécessaire
d'être soumis au régime de la franchise en base de TVA pour pouvoir
être imposé selon le régime micro-BIC. Cette disposition s'applique
à la fois aux exploitants qui dépassent les seuils de la franchise en
base de TVA tout en respectant le seuil du micro-BIC et à ceux qui
renoncent volontairement à la franchise en base de TVA en optant
pour un régime réel de TVA.
