respectivement, pour la durée de la législature par l'Assemblée nationale
et pour la durée de leur mandat par le Sénat, deux membres du Conseil
d'État nommés par le vice-président du Conseil d'État, deux magistrats
hors hiérarchie de la Cour de cassation nommés conjointement par le
premier président et par le procureur général de la Cour de cassation, et
une personnalité qualifiée pour sa connaissance en matière de communications électroniques nommée sur proposition du président de l'autorité
de régulation des communications électroniques et des postes (ArCeP).
Le président de la CNCTr est nommé par décret du président de la
république parmi les membres issus du Conseil d'État ou de la Cour de
cassation, après mise en œuvre de la procédure d'avis des commissions
parlementaires compétentes prévue par le cinquième alinéa de l'article 13
de la Constitution. La durée du mandat des membres non parlementaires
est fixée à six ans. Le mandat des membres n'est pas renouvelable.
Toutefois, ce n'est pas seulement l'indépendance de l'autorité qui représente une garantie de la protection des données à caractère personnel,
mais également la nature des pouvoirs de cette autorité. Ainsi, certaines
autorités disposent d'un pouvoir d'autorisation, d'autres d'une compétence consultative, mais dans ce cas l'avis peut être conforme ou non. Par
exemple, la CNIL autorise les traitements les plus sensibles ; en revanche,
la CNCTr est seulement saisie pour avis, lequel n'est pas conforme.

CONCLUSION
en 2008, un comité présidé par Mme Veil et mis en place par le président
de la république devait étudier la possibilité de l'introduction du droit
au respect de la vie privée dans le Préambule de la Constitution (la lettre
de mission du comité évoquait également les droits liés à la bioéthique, la
parité, le droit au respect de la dignité humaine ou le pluralisme des médias).
or, le comité conclut à l'absence de nécessité de réviser le Préambule,
car la plupart de ces droits sont déjà consacrés par la Constitution ou la
jurisprudence du Conseil constitutionnel, comme c'est le cas du droit au
respect de la vie privée17.
Toutefois, la gradation des atteintes à la vie privée résultant de la jurisprudence ne semble pas découler des textes. en conséquence de cette
interprétation contestable, certaines atteintes à la vie privée nécessitent le
contrôle d'un juge, d'autres pas. or ceci mériterait une explicitation ou
une confirmation dans le texte de la Constitution.
