A. Garder la mémoire
Garder la mémoire, c'est conserver une trace, ne pas oublier. Précisément,
il y aurait en matière pénale un recul de l'oubli de l'infraction, y compris
après l'exécution de la peine.
L'idée est évidemment illustrée par la technique du fichage lorsque la
durée de conservation des données est relativement longue. Tel est le cas
pour le FIJAIS. Selon l'article 706-53-4 du Code de procédure pénale :
- les informations sont retirées au décès de la personne ;
- ou conservées pendant trente ans s'il s'agit d'un crime ou d'un délit puni
de dix ans d'emprisonnement ;
- ou pendant vingt ans dans les autres cas.
Dans tous les cas, le délai commence à courir à compter de la fin de
l'exécution de la peine prononcée en répression de l'infraction.
Au-delà du fichier, d'autres mécanismes, également qualifiés de mesures
de sûreté, permettent de prolonger la peine et, d'une certaine manière, la
trace de l'infraction. Les dispositifs ont été introduits progressivement,
jusqu'à donner une perpétuité virtuelle à la réponse pénale27.
Participent de ce mouvement28 :
- le suivi socio-judiciaire : introduit en 1998, il doit être prononcé par la
juridiction de jugement et se caractérise par la soumission à un ensemble
d'obligations et de mesures de surveillance pour assurer un suivi de la
condamnation ; la mesure est, en principe, limitée à dix ans pour les délits
et à vingt ans pour les crimes29 ;
- la surveillance judiciaire : introduite en 2005, son contenu est sensiblement identique au suivi socio-judiciaire, à la différence qu'elle est
prononcée par le tribunal de l'application des peines au moment de la
libération30 ;
- la surveillance de sûreté et la rétention de sûreté : introduites en 2008,
elles franchissent deux étapes supplémentaires ; la surveillance post-peine
peut prendre la forme d'une privation de liberté (dans les cas les plus
