B. La gratuité des fichiers communiqués
La doctrine l'a bien perçu : « une question capitale est celle de la gratuité
ou du caractère payant de la réutilisation »80. Si le droit positif a pendant
longtemps admis la fourniture de fichiers en contrepartie du paiement d'une
redevance, il a progressivement évolué vers l'affirmation d'un principe de
gratuité de l'accès aux données publiques. La commercialisation de fichiers
devient dans ces conditions en principe de plus en plus limitée.
La possibilité initiale de percevoir des redevances de réutilisation.
La directive du 17 novembre 2003 autorisait la perception de redevances
pour la réutilisation des informations publiques, tout en en encadrant le
montant81. Les tarifs devaient en principe être orientés vers les coûts :
ainsi, le total des recettes provenant de la fourniture et des autorisations de
réutilisation des documents ne pouvait pas dépasser les coûts de collecte,
de production, de reproduction et de diffusion. Ces redevances devaient
être transparentes, les conditions et les redevances types applicables étant
fixées à l'avance et publiées82. Mais la directive permettait quand même
« un retour sur investissement raisonnable ».
Suivant ces principes, le droit positif a longtemps permis de communiquer et d'autoriser la réutilisation de données publiques en contrepartie
d'une redevance. Ces redevances étaient des redevances pour service rendu,
la communication d'un fichier constituant pour le juge administratif non
la fourniture d'un bien, mais celle d'un service83. La loi du 17 juillet 1978,
dans sa version antérieure à la loi du 28 décembre 2015, précisait ainsi que
« la réutilisation d'informations publique peut donner lieu au versement de
redevances »84. elles devaient « essentiellement » trouver une contrepartie
directe dans la prestation fournie par le service utilisé, mais son montant
pouvait excéder le coût de la prestation fournie « pour tenir compte de la
valeur économique de la prestation pour son bénéficiaire »85. Les redevances étaient fixées de façon non discriminatoire et leur niveau ne devait
pas dépasser les coûts de collecte, de production et de mise à disposition,
ainsi qu'une rémunération raisonnable des investissements, suivant les principes posés par le droit de l'Union européenne dérivé.
