police rendent inopérant le droit d'opposition, ouvrant aux administrés
un pouvoir d'agir très limité.
In fine, la liaison du savoir et du pouvoir reste imparfaite : l'accès indirect
aux informations et le taux d'erreurs contenues dans les fichiers administratifs démontrent un manque de transparence qu'aucun dispositif ne déjoue.

B. La (re)liaison du savoir et du pouvoir
Le fichage évolue en parallèle avec le droit. Le défaut de transparence
repose avant tout sur l'inapplication des règles de la loi Informatique
et Libertés59. Le pouvoir est nul sans le savoir, et le secret rend stériles
tous les dispositifs de transparence. L'accessibilité, la rectification ou
encore l'opposition sont inopérantes pour des fichiers secrets, dépourvus
de base légale, tels que le fichier clandestin sur les roms constitué par
l'office central de lutte contre la délinquance itinérante, baptisé « minorités ethniques non sédentarisées » (MeNS), révélé dans Le Monde du
8 octobre 2010, et qui comportait plus de 52 000 fiches60. Le décret du
29 mars 2011 portant création du fichier Gipasp régularisera finalement le
traitement du renseignement de sécurité publique au sein de la gendarmerie
nationale. Le pouvoir reste donc sans objet quand le savoir fait défaut.
À l'inverse, le savoir est impuissant s'il n'est pas assorti d'un pouvoir.
L'accès indirect et la rectification incombent en définitive au bon vouloir
du responsable du traitement, maintenant le pouvoir d'agir au sein de
l'administration.
Même la liaison du savoir et du pouvoir ne contraint pas de facto l'administration à respecter le droit. Dans les arrêts du 19 juillet 2010, Vincent
F.61, à propos de deux fichiers informatiques utilisés par l'Éducation nationale, remaniés par un arrêté du 20 octobre 2008 afin de supprimer les
mentions controversées comme la nationalité, la date d'arrivée en France,
la langue et la culture d'origine, le juge sanctionne des atteintes graves à
la loi. Si le juge constitue un rempart juridique aux défaillances de l'administration, son intervention est conditionnée par l'existence d'un savoir
