I - LA LIMITATION DU FICHAGE
L'encadrement légal des données de traçage est opéré tant par la loi
Informatique et Libertés que par des lois spécifiques. Au cœur du dispositif
figure principalement le régime juridique des données de connexion, des
données de consultation et des correspondances électroniques. L'impératif
est d'en contenir l'expansion et l'exploitation. La durée de conservation des
données de connexion (A) et les hypothèses de communication à des tiers
des données de traçage (B) doivent être pensées en lien avec le principe de
finalité du traitement.

A. La durée de conservation des données de connexion
Le principe de finalité est une des pierres angulaires du dispositif
« Informatique et Libertés ». Aux termes de l'article 6-2 de la loi de 1978,
les données à caractère personnel sont « collectées pour des finalités déterminées, explicites et légitimes et ne sont pas traitées ultérieurement de
manière incompatible avec ces finalités », des exceptions étant prévues
pour les traitements statistiques ou de recherche scientifique et historique.
Corollaire du principe de finalité, le principe de proportionnalité postule,
à l'article 6-3, que les données doivent être « adéquates, pertinentes et non
excessives au regard des finalités pour lesquelles elles sont collectées et de
leurs traitements ultérieurs ».
Le principe de finalité doit ainsi guider la détermination de la durée de
conservation des données. Cette limitation de la durée de conservation est
un des éléments centraux de la protection, en ce qu'il garantit à l'individu
une forme de droit à l'oubli de données, à la collecte desquelles il n'a pas
été en mesure de s'opposer. Face à des traitements obligatoires ou indispensables, la fixation de limites à la durée de mise en mémoire constitue
une dernière soupape de sécurité pour la personne concernée. Cette préoccupation est particulièrement vive à l'égard des données de connexion,
appelées aussi données de trafic, et le débat est toujours aussi âpre et
difficile sur la détermination de durées tolérables. La conservation de telles
données porte, en effet, atteinte au droit fondamental à la confidentialité
des communications. Le groupe de travail « article 29 » sur la protection
des données, organe consultatif européen indépendant institué auprès de
la Commission européenne, a rappelé qu'une telle restriction devait être
justifiée par une « nécessité urgente », n'être autorisée que « pour une durée
