A. Le contrôle du fichage par la CNIL
La CNIL est, dans certaines hypothèses, amenée à prononcer des autorisations57, ou seulement rendre des avis58, sur la mise en oeuvre de certaines
applications informatiques, subordonnant son accord à des garanties quant à
la nature des données collectées, leur utilisation, l'information et le consentement des personnes concernées ou la sécurité des traitements59. outre
la vérification de l'accomplissement des formalités obligatoires, la CNIL
« reçoit les réclamations, pétitions et plaintes relatives à la mise en oeuvre
des traitements de données à caractère personnel et informe leurs auteurs
des suites données à celles-ci »60. À cet effet, la commission a le pouvoir
de contrôler la mise en oeuvre des traitements, au moyen de contrôles sur
place et sur convocation et, depuis 2014, au moyen de contrôles en ligne61.
en fonction de ses constats, la Commission peut prononcer un certain
nombre de sanctions, telles qu'une sanction pécuniaire, un avertissement,
une injonction de cesser le traitement, un retrait de l'autorisation accordée,
une interruption de la mise en œuvre du traitement, pour une durée maximale de trois mois, ou le verrouillage de certaines des données, pour une
durée maximale de trois mois62. en cas d'atteinte grave et immédiate aux
droits et libertés mentionnés à l'article 1 de la loi de 1978, le président de
la CNIL peut « demander, par la voie du référé, à la juridiction compétente
d'ordonner, le cas échéant sous astreinte, toute mesure de sécurité nécessaire à la sauvegarde de ces droits et libertés »63 ou dénoncer au Parquet
les infractions dont elle a connaissance64.
en matière de traçage, la CNIL a, par exemple, effectué plusieurs
contrôles des modalités de mise en œuvre des services d'internet en
libre accès, auprès d'organismes privés et publics. Son attention a principalement porté sur le type de données collectées, leur conservation, le
niveau d'information des utilisateurs et la qualité des mesures de sécurité qui y sont associées. La Commission a, par exemple, constaté que de
nombreux opérateurs « conservaient des données portant sur le contenu des
